Photography, recording and media policy

What is recorded in our studios, what is not, and what you may and may not record.

No cameras are installed, and no cameras will be installed, in changing areas, bathrooms, showers, or any area with a reasonable expectation of privacy. Under New York Penal Law section 250.45, unlawful surveillance in the second degree, recording a person in a bedroom, changing room, fitting room, restroom, toilet, bathroom, washroom or shower can be a class E felony. We do not permit any employee, contractor or member to place, operate or view any recording device in those areas, on our premises, at any time, for any reason.

1. Security cameras

Continuously operating security cameras, video only and no audio, are installed at the entrance and reception areas of each studio, on the studio floor covering the reformers at wide angle only in order to record incidents and misuse of equipment, and in back-of-house corridors leading to the class area.

2. Signage

A sign at each entrance and at the entrance to the class floor states that video surveillance is in operation. The Privacy notice explains how the footage is stored, who can access it, and for how long.

3. Retention and access

Footage is retained for thirty days by default and then deleted, unless it is being reviewed in connection with an incident such as an injury, damage or a complaint, or a lawful request. Access is restricted to the founders, the studio manager, and outside counsel or law enforcement on written request. Footage is not used for marketing, for performance monitoring of members, or for any purpose other than safety and security.

4. Requests for footage

You may ask us in writing whether footage of you exists and, subject to the rights of others captured in the same footage, ask for a copy. We will respond within a reasonable time.

5. Members photographing or recording

Members and guests may not photograph or record video or audio of another person on the premises without that person's express, contemporaneous consent. Selfies in the reception area are fine so long as no other person is identifiable. Recording of any kind is not permitted in changing areas, bathrooms, or a class in progress.

6. Our use of your image

We do not use member images in marketing without express written opt-in. If you would like to feature, tell us and we will send you a short release with the scope you approve.

7. Instructor demonstrations

For instructor demonstrations that will be published, we will clear the frame of any member who has not opted in, or shoot outside class hours.

8. Live streaming and on-demand

If we begin to stream classes we will publish a separate notice, provide separate consent to being in frame, and give members a way to opt out of being recorded.

9. Enforcement

Violation of this policy is grounds for immediate removal from the studio and termination of the pack with a pro-rata refund of unused credits. Recording in a protected area may be reported to law enforcement.
